1. This agreement
These Terms of Use (the “Terms”, and for the mobile app the “End User Licence Agreement” or “EULA”) are a contract between you and BAS Events, based in Iraq (“BAS”, “we”, “us”), the operator of the BAS Events app and this website (together, the “Service”).
By downloading, installing or using BAS Events, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
2. Who may use BAS
You must be at least 13 years old to use BAS Events, and old enough to form a binding contract where you live. If you use the Service on behalf of an organization, you confirm you are authorised to bind that organization to these Terms.
3. Your account
Browsing does not require an account. To save events, mark that you are going, comment, report content, block other users or submit an event, you sign in with a link sent to your email, with Sign in with Apple, or with Google. You are responsible for keeping access to that email or sign-in account secure, and for everything done through your BAS account. Tell us at info@bas-iq.com if you suspect unauthorised access. You may delete your account at any time — see Deleting your account.
4. Licence to use the app
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the BAS Events app on a device you own or control, for your own non-commercial use. For apps obtained through the Apple App Store, this licence is further limited to use on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
You may not copy, modify, translate, reverse engineer, decompile, disassemble, rent, lease, lend, sell, redistribute or create derivative works from the app, except where that restriction is prohibited by applicable law.
5. Acceptable use
BAS Events has zero tolerance for objectionable content and abusive users. When using BAS Events you must not:
- Post an event that is fictional, cancelled, misleading about its time, place, price or organizer, or that you have no authority to list;
- Post content that is unlawful, defamatory, hateful, sectarian, threatening, sexually explicit, or that incites violence or discrimination;
- Upload images you do not have the rights to, or photographs of identifiable people who have not agreed to be published;
- Harass other users, impersonate any person or organization, or misrepresent your affiliation with one;
- Spam the platform with duplicate listings, or use it primarily as an advertising channel for unrelated goods and services;
- Scrape, crawl, bulk-download or systematically copy listings, or use automated means to access the Service beyond normal app use;
- Interfere with the Service, probe it for vulnerabilities without our written permission, or attempt to gain access to accounts or data that are not yours;
- Use the Service to break any law that applies to you.
6. Event listings
You keep ownership of everything you submit. By submitting an event, photo or comment you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, translate, display and distribute that content within the Service and in reasonable promotion of the Service, for as long as your content remains published. The licence continues for approved events that stay published after you delete your account, as described on our account deletion page; your identity is removed from those events. For all other content, it ends when the content is removed.
You confirm that you have the right to grant this licence, that the event is real, and that the details you provide are accurate. Organizers remain solely responsible for their events, for anything that happens at them, and for complying with the permits, safety rules and local laws that apply.
7. Moderation and removal
Every submission is reviewed before it is published. We may approve, reject, edit for clarity, or later remove any listing or comment at our discretion — particularly where it breaches section 5, where a user reports it, or where we cannot verify it. Rejection is not a judgement about you or your event.
You can report any event or comment from inside the app, and you can block a user so that their comments are hidden from you. We review reports and remove content that breaks these Terms, and we may suspend or remove users who post it.
8. We do not run the events
BAS Events is a listing and discovery platform. We do not organize, host, endorse, inspect or supervise the events shown in the app, and we are not a party to any arrangement between you and an organizer. Times, prices, venues and line-ups are supplied by organizers and can change or be cancelled without notice. Always confirm details with the organizer before travelling, and use your own judgement about your safety at any gathering.
9. Tickets and payments
BAS Events does not sell tickets and does not process payments. Where a listing shows a price or links to a ticket seller, the transaction is between you and that organizer or seller under their terms, including their refund policy. We cannot issue refunds for a third party’s event.
10. Third-party services
The Service uses third-party components, including map data and tiles, and links out to navigation apps, organizer websites and social profiles. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or availability.
11. Intellectual property
The BAS Events name, logo, app design, interface, text and software are owned by us or our licensors and are protected by intellectual property law. These Terms give you no right to use our branding without written permission, except to refer to the Service as it is.
12. Suspension and termination
You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms, if your listings repeatedly fail moderation, or if we are required to by law. If we terminate your account without cause, and the Service is one you paid for, you may ask for a proportionate refund of anything unused. Sections 6, 8, 11, 13, 14, 15 and 17 survive termination.
13. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any listing is accurate, complete or current.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, BAS and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunity, arising from your use of the Service, from any event you attend or fail to attend, or from any dealing with an organizer or other user.
Where liability cannot be excluded, our total aggregate liability to you is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or 50,000 IQD. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
15. Indemnity
You agree to indemnify and hold us harmless from any claim, damage, loss or expense (including reasonable legal fees) arising out of content you submit, an event you list or run, your breach of these Terms, or your violation of anyone else’s rights.
16. Apple App Store terms
The following applies where you obtained the app from the Apple App Store:
- This EULA is concluded between you and us only, not with Apple. Apple is not responsible for the app or its content.
- We, not Apple, are solely responsible for providing maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that party’s intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce it against you.
- You must also comply with any applicable third-party terms of agreement when using the app, including your wireless data service agreement.
17. Governing law
These Terms are governed by the laws of the Republic of Iraq, without regard to conflict-of-law rules. The competent courts of Iraq have exclusive jurisdiction, except where mandatory consumer law in your country of residence gives you the right to bring a claim locally.
18. Changes to these Terms
We may update these Terms as the Service develops. We will change the “Last updated” date and, for material changes, notify you in the app or by email before they take effect. If you keep using the Service after a change takes effect, you accept the new Terms.
